Newsflash: International mobility of persons: activation of the "Temporary Protection" Directive

Context and principle

Due to the current war situation in Ukraine, the Council of the European Union has decided to activate for the first time since its adoption, Directive 2001/55/EC implementing the temporary protection intended to face a massive influx of displaced persons (due to armed conflict).  The provision came into force on 4 March 2022 throughout the European Union.

This protection is temporary. It will be valid for one year but can be extended for two six-month periods. 

Beneficiaries are Ukrainian nationals and their family members who had their main residence in Ukraine before February 24, 2022. Some non-Ukrainians residing in Ukraine may benefit from this protection under certain conditions.

Consequences for residence and work permits?

Ukrainians who have registered and obtained a "temporary protection" residence permit issued by the municipality of residence are entitled to work as employees without having to apply for a work permit (self-employed activity still require a prior work authorization (professional card).
